These Terms of Service (“Terms”) govern access to and use of the Magspire platform (“Platform,” “we,” “us,” “our”), operated by Magspire Educational Consultant, a business registered in Oyo State, Federal Republic of Nigeria.

By creating an account or using the Platform, you agree to be bound by these Terms.

1. What Magspire Is

Magspire is a Computer-Based Test (CBT) practice and learning platform offering mock examinations, past-question practice, analytics, and study tools for JAMB (Unified Tertiary Matriculation Examination, UTME) and Post-UTME candidates.

1.1 Non-Affiliation Disclaimer

Magspire is an independent educational study platform. This platform is not affiliated with, endorsed by, sponsored by, or in any way officially connected with the Joint Admissions and Matriculation Board (JAMB), any university, polytechnic, college of education, or any Post-UTME administering institution referenced on the Platform. Any references to JAMB, UTME, Post-UTME, specific institutions, or examination bodies are used solely to describe the educational subject matter of the practice content and do not imply endorsement.

1.2 No Guarantee of Results

Performance on Magspire mock exams (including scores, percentiles, and leaderboard rankings) is provided for practice and self-assessment purposes only. We do not guarantee that use of the Platform will result in any specific score, outcome, or admission in the actual UTME, Post-UTME, or any examination administered by JAMB or any academic institution.

2. Eligibility and Accounts

2.1 Age and Parental Consent

The Platform is intended for use by secondary school students and UTME/Post-UTME candidates, many of whom are minors under Nigerian law (the age of majority in Nigeria is 18).

• If you are under 18, you may only use the Platform with the involvement, knowledge, and consent of a parent or legal guardian, who should review these Terms and our Privacy Policy on your behalf before you register.
• By registering an account for a user under 18, a parent or guardian confirms they have reviewed and accepted these Terms on that user’s behalf.
• We reserve the right to request proof of parental consent at any time and to suspend accounts where this cannot be confirmed.

2.2 Account Registration

You agree to provide accurate registration information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

2.3 Roles

The Platform operates under distinct account roles (Admin, Staff/Tutor, and Standard/Premium Student), each with specific access privileges as described at registration and within the application.

3. Single-Session and Anti-Sharing Policy

To protect the integrity of paid access and exam results, each account is limited to one active login session at a time. Attempting to log in from a second device while a session is active will be blocked until the first session ends. Sharing your username, passkey, or password with another person to gain unauthorized access is a violation of these Terms and will result in account suspension without refund.

4. Subscriptions and Payment

Access to premium practice exams and full test suites requires payment as described in our Refund and Subscription Policy. Payments are processed through secure third-party payment processors (Paystack and/or OPay); we do not store your card or bank credentials.

5. Intellectual Property

5.1 Our Content

All software, user interface designs, compiled question banks, proprietary explanations, scoring algorithms, the Learn & Earn scoring formula, and platform branding are the intellectual property of Magspire Educational Consultant or its licensors. Past examination questions used on the Platform may be drawn from publicly available past papers; our proprietary contribution (the compiled question sets, answer explanations, randomization system, scoring engine, and user interface) remains fully protected.

5.2 Prohibited Conduct

You agree not to:

• Scrape, bulk-download, screenshot in bulk, reverse-engineer, or redistribute the question bank, explanations, or platform software;
• Use bots, scripts, or automated tools to extract questions, simulate exam attempts, or manipulate scores;
• Share paid account access with unauthorized users;
• Copy or republish platform content on any other website, app, or service without prior written permission.

Violation of this section may result in immediate account termination and appropriate legal action.

6. Academic Integrity

Use of the Platform is subject to our Academic Integrity and Acceptable Use Policy, which prohibits credential sharing, automated exam-taking, and any conduct that undermines fair use of the Platform.

7. Learn & Earn Competition

Participation in the Learn & Earn leaderboard and any associated cash prizes is governed by separate Official Rules, which form part of these Terms by reference.

8. Disclaimers

8.1 Service Provided “As Is”

The Platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or fully continuous access at all times. Scheduled or unscheduled maintenance and downtime may occur.

8.2 No Professional Advice

Nothing on the Platform constitutes formal educational, admissions, or career counseling. Always confirm official JAMB and Post-UTME requirements, deadlines, subject combinations, and procedures directly from JAMB and the relevant admitting institutions.

9. Limitation of Liability

To the maximum extent permitted by Nigerian law, Magspire Educational Consultant and its directors, staff, and tutors shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of the Platform;
• Loss of exam session progress due to network failure, device issues, or third-party service outages;
• Any actual UTME, Post-UTME, or university admission outcome.

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold Magspire Educational Consultant harmless from any claim, loss, or damage arising from your violation of these Terms, misuse of the Platform, or violation of any third-party right.

11. Termination

We reserve the right to suspend or terminate any account, without refund, for violation of these Terms, the Academic Integrity Policy, or suspected fraudulent activity (including credential sharing and Learn & Earn manipulation), at our sole discretion.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or an in-app notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation, and failing that, shall be subject to the exclusive jurisdiction of the competent courts of Oyo State, Nigeria.

14. Force Majeure

We shall not be liable for failure to perform any obligation due to events beyond our reasonable control, including but not limited to internet service provider failures, national grid power outages, government action, or third-party service provider outages.
